These Terms of Service ("Terms") constitute a legally binding agreement between you and DMarkethub LLC ("we," "us," or "our"), operating as SitStayBook. By accessing or using our website at sitstaybook.com (the "Site") or engaging our services, you agree to be bound by these Terms.

Services description

SitStayBook provides consulting and platform services designed to help dog trainers grow their businesses. Our services include, but are not limited to:

• Google Business Profile optimization and local SEO
• Website design, hosting, and maintenance
• Booking system setup and integration
• Operations automation and workflow optimization
• Strategic consulting and implementation support

Services are typically delivered through focused 2-3 week sprints with clearly defined scopes. Ongoing support and maintenance plans are available but optional.

The specific scope, deliverables, timeline, and pricing for each engagement are determined through a discovery process and documented in a separate agreement or proposal.

Eligibility

By using our Site or services, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into binding contracts
• You will provide accurate and complete information
• You will comply with all applicable laws and regulations

User obligations

When using our Site or services, you agree to:

Service terms & client responsibilities

Delays caused by lack of client cooperation may result in extended timelines. We are not responsible for delays outside our control.

No guarantees

While we work diligently to deliver high-quality services, we cannot guarantee specific business results, rankings, traffic levels, or revenue outcomes. Success depends on many factors, including market conditions, competition, and your own business practices.

Payment terms

Pricing for our services is determined on a per-engagement basis and will be clearly communicated in your proposal or agreement.

• Payment terms will be specified in your service agreement
• Invoices are typically due within 7-14 days of issuance
• Late payments may result in service suspension
• All fees are in U.S. dollars unless otherwise specified

Refund policies, if applicable, will be outlined in your specific service agreement. Generally, work already completed is non-refundable.

Intellectual property

Our intellectual property

The Site, including all content, features, functionality, and design, is owned by DMarkethub LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Client deliverables

Upon full payment, you will own the custom deliverables created specifically for your business (such as website content, graphics, and configurations). However, we retain ownership of:

• Our proprietary tools, systems, and methodologies
• Template designs and reusable components
• The SitStayBook platform and software

Client content

You retain ownership of any content, materials, or information you provide to us. By providing such content, you grant us a license to use it solely for the purpose of delivering our services.

Third-party services

Our services may integrate with or rely on third-party platforms and services (such as Google, hosting providers, or payment processors). We are not responsible for:

• The availability, functionality, or policies of third-party services
• Changes to third-party platforms that affect our services
• Fees charged by third-party providers
• Data breaches or issues with third-party services

Your use of third-party services is subject to their respective terms and conditions.

Disclaimers & warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

We do not guarantee specific business outcomes, search rankings, website traffic, lead generation, or revenue results. Your success depends on many factors beyond our control.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DMARKETHUB LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SITE OR SERVICES.

Our total liability for any claims arising from or related to our services shall not exceed the amount you paid us in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless DMarkethub LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

Termination

Either party may terminate a service engagement according to the terms specified in the service agreement. We reserve the right to suspend or terminate your access to our Site or services at any time, without notice, for:

• Non-payment of fees

• Any reason at our sole discretion

Upon termination:

• You remain responsible for any outstanding fees
• We may cease providing services immediately
• Provisions regarding intellectual property, liability, and indemnification survive termination

Governing law & dispute resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or our services shall be resolved in the state or federal courts located in Snohomish County, Washington. You consent to the exclusive jurisdiction and venue of such courts.

Before filing any legal action, the parties agree to attempt to resolve disputes through good-faith negotiation.

Miscellaneous

Entire agreement

These Terms, together with any service agreements and our Privacy Policy, constitute the entire agreement between you and DMarkethub LLC regarding the use of our Site and services.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
